Gloucester Police/Fire: Man faces drunken boating charge after marina crash

A Gloucester man was arrested for driving a boat while under the influence of alcohol, after the 26-foot bayliner he was operating crashed into a vessel docked at the Cape Ann Marina Sunday about 7:10 p.m.

Philip W. Budrose, 29, was charged after a woman fell from Budrose’s boat into the water during the crash, and the owner of the other boat who had been in a parking lot nearby, rescued the woman from the water.

Officers said that the woman “appeared to be highly intoxicated.”

Budrose, who police also found to be allegedly intoxicated, appeared to be unaware that the woman had fallen overboard, the other boat owner told police.

Police asked Budrose to perform sobriety tests, and he failed multiple tests, then declined to submit to a Breathalyzer after his arrest.

A woman driving without a license on Patriots Circle allegedly struck and killed a small, unleashed dog Saturday morning. She faces an unlicensed driving charge. The woman, Diana Martinez, 36, told police she was driving with her boyfriend in the vehicle and neither of them had been aware of possibly striking a dog. Police also plan to charge the vehicle owner, Kelvin Lopez, with allowing an unlicensed person to drive. He was not the other person in the car.

A witness told police that the dog ran between the vehicle’s front and rear wheels and the vehicle did not change speed after allegedly striking the animal.

Still, the dog’s owner found Martinez and her passenger at Martinez’s home and “screamed at them uncontrollably,” Saturday afternoon, according to police.

The dog owner was demanding an apology, but a “language barrier” prevented Martinez from understanding her. When a neighbor attempted to mediate and assist, the dog owner allegedly “became irate and commenced making racial slurs” towards the neighbor.
