Gloucester District Court: Man gets probation for assault with vase

A 40-year-old Gloucester man was handed a year’s probation after pleading guilty in Gloucester District Court to throwing a vase and hitting a woman in the head.

David McGibbon Jr., 40, admitted to an assault charge stemming from an March 8 incident in which he threw the vase, striking a woman’s head with the item, according to a police report.

McGibbon was placed on probation until next year and ordered to pay a $50 court fee, remain alcohol free and undergo anger management counseling. The court dismissed an additional charge of assault and battery with a dangerous weapon against McGibbon at the state’s request.

Charges of property vandalism and disturbing the peace against 23-year-old Taylor N. Geden of Washington Street were both dropped because of failure to prosecute in court.

Geden had been accused of using toothpaste to write insults on a vehicle, according to a police report.

An assault and battery charge against 24-year-old Addison Street resident was also dismissed due to failure to prosecute in a court trial Monday. Mary Klics faced the charge after she was arrested March 10 on charges of throwing a 56-year-old woman to the ground, according to a police report.

A judge decided Christopher Montgomery, 20, had admitted to sufficient facts on a charge of heroin possession, but the judge continued the case to September 2014 without a finding. Still, Montgomery was ordered to pay a $50 assessment, and to remain sober of drugs and alcohol. He will be subject to random drug and alcohol screens, police said.

Charges of unlicensed driving against Judson Deoliveira, 53, will be dismissed if he pays court costs of $200, a judge decided at his Tuesday arraignment. Police had stopped Deoliveira for failing to stop at a sign on the corner of Essex Avenue and Western Avenue, and learned Deoliveira was an unlicensed driver, according to a police report.
