---- — Two Gloucester men are facing larceny charges after they allegedly took in more than $160,000 after failing to produce an antique car reportedly paid for by an Essex restoration company.
Philip Budrose, 69, of Fort Hill Road on Eastern Point and Carlo D’Alelio, 50, of Norman Avenue in Magnolia are being charged with the larceny after failing to deliver a 1954 Mercedes 300s Roadster, valued at $160,000 according to Sheila Wilson, a representative from the restoration company Paul Russell and Co. in Essex.
The company specializes in the restoration, brokerage, sales and maintenance of European cars made before World War II through the 1960s.
According to Wilson’s criminal complaints, Budrose had approached the company in May of last year, offering to sell the car. A check was made out to Budrose for $160,000, which was deposited in his account.
Budrose then paid D’Alelio to transport the car, according to court papers, while Paul Russell and Company then let D’Alelio borrow four antique tires and rims so he would be able to drive the car to the shop’s location in Essex.
Court documents state the car and the tires — valued at $6,000 themselves — have still not been received
Wilson alleges Budrose has used the money for personal use. The company has asked for the car on repeated occasions since Budrose offered to sell the car in May of last year, court papers indicate.
The two Gloucester men were released on personal recognizance bail, but could be arrested should the terms of their release be broken on Tuesday, according to court documents.
“They never delivered the car or their tires and spent our money,” Wilson wrote in a criminal complaint earlier this year.
A pretrial hearing is set for August 30.
Budrose has tapped Salem-based attorney Edward McNaught III, while D’Alelio has hired attorney Edward Harrington of Boston.
“Mr. D’Alelio has every intention of paying back the party in question,” Harrington said Tuesday.
