Thieving lottery loser is handed probation

The young Rockport man who griped at the time that he and his brother used the loot from two break-ins to buy Lottery tickets yet "didn't even win" has fared better in Gloucester District Court.

Christopher Todd, 20, of 1 Kitefield Road, Rockport, was handed a probation sentence after admitting to charges that he helped his younger brother break into a Rockport lobster company on two separate occasions in August.

Todd was placed on 18 months' probation by Judge Joseph Jennings on charges of felony breaking and entering and receiving stolen property. Todd also had conspiracy charges dismissed.

According to police reports, Todd confessed to keeping lookout while his younger brother, Justin, 18. broke into Roy Moore Lobster Co. on Bearskin Neck the first night. He also told police he helped his brother slide through a window the next night.

Officials say that, when Justin Todd broke into the lobster company the night of Aug. 27, he took $120 in $10 and $20 bills.

Police said Justin shared the money with Christopher that Thursday night — and that it was Christopher's idea to return to the business the following night.

The second time, the Todd brothers gained access to the building through the same opening, even though it had been mostly boarded up by the owners, Ken and Karin Porter.

According to police, the Porters opted not to leave any money in the register after the first night's break-in, but they forgot about a stash of $2 bills and $1 coins worth nearly $100 — all of which the siblings allegedly stole.

According to the police report, the young men used the rare $2 bills and gold-colored $1 coins to purchase Lottery tickets at Rockport Market. An employee tipped police off to the strange purchase and turned over video footage of the young men, which allowed police to identify the suspects.

Christopher Todd reportedly told police they "spent a lot of the money on scratch tickets — and we didn't even win."

Justin Todd was also charged with breaking into YMCA Ben Beyea Youth & Teen Center in November.

In that case, police responded when the Teen Center staff reported that someone had apparently broken into the facility Sunday and stole $20 from a cash box.

Police said at the time that recently installed surveillance cameras captured the suspect on tape. And Teen Center Director Nikki Klink later identified the individual captured on film as Justin Todd, police said.
