Judge Ellen Flatley dismissed a charge of assault and battery brought against Eric Aiken, 54, of no known address, Friday in Gloucester District Court.
The charge was dismissed on failure to prosecute.
Flatley also dismissed a charge of leaving the scene of property damage brought against Keith Hunt, 17, of 27 Forest Ave. for failure to prosecute.
