May 06, 2008 10:32 pm r An Ipswich man charged with unlicensed operation of a motor vehicle and a marked lanes violation had his cased dismissed Tuesday upon payment of $100 by Judge Albert Conlan in Gloucester District Court. Marcelo O. Leite, 22, of 16 Central St., No. 4, Ipswich, was charged March 31 after Essex police pulled over the driver of a 1996 Toyota Tercel on Eastern Avenue for repeatedly crossing the fog lines. According to the police report, Leite showed the officer a Brazilian license and passport and told the officer he had been in the United States for two years. Leite had to be picked up by a friend as police decided to have the vehicle towed from the scene. Leite paid the $100 fee Tuesday and was found not responsible for the marked lanes violation. r A Gloucester man who pleaded guilty to a charge of assault and battery received a one-year suspended sentence and was put on probation for two years by Judge Joseph Jennings in Gloucester District Court on Monday. Christopher C. Forbes, of 27 Marsh St., was charged with assault and battery on Jan. 2, 2007, after police responded to an Oak Street apartment building for a report of a dispute. Forbes told police he was watching television with his 2-year-old daughter when someone started "pounding" on his apartment door, startling him. Forbes told police when he opened the door, a neighboring tenant tried to enter. Feeling threatened, Forbes prevented the neighbor from entering. Forbes told police the neighbor did fall down the stairwell but did not say how. The neighbor, whose face was bloodied when police arrived, told police Forbes had knocked him down the staircase. Forbes, 38, was also ordered to enter and complete an anger management program and was assessed $50 in court costs. r A 50-year-old Gloucester man facing an assault and battery charge had his case dismissed Monday because of a failure to prosecute. Phillip J. Hobbs, of 20 Corliss Ave., appeared in court for an incident that took place Feb. 18 after police responded to a report of a domestic dispute. r Christopher Rivera, of 144 Dudley St., No. 215, Roxbury, pleaded guilty to receiving stolen property, two counts each of larceny by check over $250, forging checks and uttering false checks. He was sentenced to 200 days in jail with 100 days to be served and the balance suspended. He was also placed on probation for three years. Rivera, 34, was assessed $90 in court costs. According to Gloucester and Rockport police reports, Rivera cashed three checks that had been stolen from a joint account belonging to a Rowley Shore couple. Three checks were stolen from the victim's briefcase at his office in Burlington in January. Rivera forged the checks in the amounts of $800, $700 and $550, cashing two at Rockport National Bank on Parker Street, and the third at the Rockport National Bank branch on Main Street in Rockport.
