Man with firearm charged with threat to murde

A city man accused of holding an unloaded gun to a woman’s head and threatening to murder her was first served with an emergency restraining order, then arrested a half-hour later Tuesday evening.

Now, Keith J. Bertone, 41, is facing charges of assault and battery with a deadly weapon, making threats to commit murder and a charge of violating a protection order.

According to a police report, when officers served Bertone the restraining order, he told them he owned no guns because of his status as a convicted felon.

But when officers returned to arrest Bertone, they found a small handgun in the drawer of a bedside table.

A condition of the restraining order prohibited Bertone from keeping weapons once the order was served to him.

About a week had passed since Bertone allegedly held the unloaded antique handgun to the woman’s head and told her he would kill her, according to police.

The woman told police she had kept the incident a secret for a week because she was afraid to disclose the nature of her relationship with Bertone. Bertone had apparently become enraged when the woman told him she needed to leave, she told police, adding that Bertone thought the two had not spent enough time together that day.

The woman told police that “since then she has been receiving threats via text messages and has become increasingly scared as time has gone on,” an officer wrote in the report.

She showed police one message on her phone from Bertone that said “I’ll (expletive) murder u.”

A half-hour after serving the restraining order, police returned to Bertone’s Washington Street apartment to make the arrest.
